Islamic Ruling on Funeral Expenses in Inheritance

Question

My mum passed away 10 years ago and we are trying to finalize the heritage. One of his son paid the funerals. What is the rulling of islam regarding this ?

Verified

(1) Funeral expenses

In Islam, the necessary expenses of burial (kafan, funeral, and burial costs) should be paid from the deceased person’s estate before distributing the inheritance.

(2) If one son paid from his own money

If he paid without the intention of taking it back (as a help or charity), then he cannot later claim this amount.

But if he paid on behalf of the estate or with the intention of reimbursement, then this amount should be returned to him from the estate first, and only after that the remaining wealth should be divided among the heirs.

(3) Distribution of inheritance

After paying funeral expenses and any debts, the remaining property should be distributed among the legal heirs according to Islamic law.

 (4) At the end:

Please write the complete details of all heirs (for example: sons, daughters, husband, parents, etc.) and then ask the question again, so that the correct Islamic shares can be explained clearly.
