Has Divorce Occurred After Saying Talaq in Anger?

Question

My wife said she wants divorce i asked her if you really wants it three times and she said yes to all and then i said okay then i will give you divorce. Now has divorce happened between us ? What is the ruling ?

Islamic Ruling & Answer

Verified

1.Talaq (divorce) only takes place with a clear statement (ṣarīḥ lafz), such as:

“I divorce you.”

“You are divorced.”

“I have given you talaq.”


Or with an indirect/unclear statement (kināyah lafz) if it is accompanied by the intention of divorce.

Example: “Go back to your family,” “You are free,” etc., but only if the husband intends divorce.



2. In your case, you only said:

Okay, then I will give you divorce.”



This is a future promise, not an actual pronouncement of talaq.

Saying “I will give you divorce” does not count as divorce.

Divorce only happens when you actually pronounce it in the present (e.g., “I give you divorce”).



3. So, no divorce has happened yet between you and your wife.

If you later say in clear words “I divorce you” even once, then one talaq will be valid.

Islam dislikes divorce except when necessary. The Prophet ﷺ said:

> “Of all the lawful things, divorce is the most hated by Allah.” (Abu Dawood, Hadith 2178)
