Can You Ask for Evidence Before Judging a Dispute?

Question

Assalamualaikum. A question has arised in my mind .What should be done , if there was dispute between two people and one was not there to know what really happened and both people have told their side of story and the person doens't want to stay neutral , so can she /he asks for proof , if it may include chats , or ask other witnesses there to get info about what happened. Thank you.

Walekumussalam,

If two people have a dispute and a third person was not present, then he/she should not immediately accept one side and make a decision. In Islam, the principle is that no statement should be accepted without verification.

Quran :

ŲŠŲŽØ§ ØŖŲŽŲŠŲ‘ŲŲ‡ŲŽØ§ Ø§Ų„Ų‘ŲŽØ°ŲŲŠŲ†ŲŽ ØĸŲ…ŲŽŲ†ŲŲˆØ§ ØĨؐ؆ؒ ØŦŲŽØ§ØĄŲŽŲƒŲŲ…Ų’ ŲŲŽØ§ØŗŲŲ‚ŲŒ Ø¨ŲŲ†ŲŽØ¨ŲŽØĨŲ ŲŲŽØĒŲŽØ¨ŲŽŲŠŲ‘ŲŽŲ†ŲŲˆØ§

(Al-Hujurat: 6)

Translation:  O believers! If a sinful person brings you news, then verify it carefully.

Based on this aayat :

If you want to know the truth, you may ask for proof.

It is permissible to ask witnesses, as long as the intention is justice, not humiliation or curiosity.

You may also ask to see chats or other evidence, but only as much as needed to clarify the truth.

Supporting one side without investigation may lead to injustice.

Important Point:

If you are not directly involved in the dispute and you have no religious or practical responsibility to judge, then it is better to remain neutral and try to bring reconciliation between them.

 The Prophet īˇē said:

Ø§Ų„Ų’Ų…ŲØŗŲ’Ų„ŲŲ…Ų ØŖŲŽØŽŲŲˆ Ø§Ų„Ų’Ų…ŲØŗŲ’Ų„ŲŲ…Ų Ų„ŲŽØ§ ŲŠŲŽØ¸Ų’Ų„ŲŲ…ŲŲ‡Ų ŲˆŲŽŲ„ŲŽØ§ ŲŠŲØŗŲ’Ų„ŲŲ…ŲŲ‡Ų

(Bukhari, Muslim)

Translation: A Muslim is the brother of another Muslim; he does not oppress him, nor does he abandon him.
