Hukm of Hurmat al-Musaharah in indirect contact case
Question
Assalamu alaykum I wanted to know if hurmat e musahara had happened in this case according to the Hanafi Fiqh. I was holding something for my father and whilst his hands were in I felt sexual, has hurmat e musahara happened? Also there was this other time I was helping my dad and held out the packet for him. His hands were stuck in the packet so I had to take the packet out of my dad's hands, whilst I did this I felt sexual since I could feel the packet coming of his skin. What is the hukm of this and does the hukm change if the person in question has a hypersexuality disorder? Also if hurmat has happened, they can't tell their parents so how does one go forward? Is it permissable to adopt the shafi'yyah madhab in this case. JazakAllah
Islamic Ruling & Answer
VerifiedWalekumussalam,
The situation you described does not establish hurmat al-musaharah according to Hanafi fiqh, because there was neither direct physical contact of the type upon which this ruling is based, as a packet or similar object was in between, nor was there any sexual desire from the fatherโs side. Mere feelings or a sexual sensation arising from one side alone do not establish hurmat al-musaharah, even if a person suffers from hypersexuality or intrusive sexual thoughts. Therefore, the marriage of the parents is unaffected, and such misgivings should be ignored.
