Question
If you owe some one money and that person has passed away and u can locate their family. Can u make a well on there name as Sadka jariya
Islamic Ruling & Answer
First, you should make every possible effort to locate the heirs or relatives of the person to whom the debt is owed. If you are unable to locate the creditor and cannot find out the whereabouts of any of his heirs or relatives, then in such a situation, you should give an amount equal to the debt you owe in charity to a poor person, with the intention that the reward be conveyed to the deceased.
Therefore, having a well constructed can also be a form of Sadaqah Jariyah, provided that the intention is to give it as charity on behalf of the deceased, and not to consider it a definite substitute for repaying the debt.
If, at some later point, the deceasedâs heirs come forward and demand this amount from you, then if they agree to the amount having been given in charity, that is fine. Otherwise, you will be required to pay the same amount to the heirs.
And Allah knows best.
