Is a Khula Signed Under Pressure Valid in Islam?

Question

About forced khula / divorce If a husband and wife signed khula/divorce papers under coercion, where: – the wife was threatened with being thrown out of her parents’ house if she did not sign, – the husband was under extreme family pressure, emotional breakdown, and fear, – neither of them intended separation in their heart, then is this khula Islamically valid according to Qur’an and authentic Sunnah?

Verified

No, this khula is not valid in Shariah. Khula is a contract based on free consent. Force or severe pressure (ikrah) makes it invalid, even if papers are signed.

Reference :

“وَلَا تُكْرَهُوا أَنْ يَتَزَوَّجَكُنَّ”

"Do not force them into marriage." (Surah An-Nisa: 19) 

 Force cancels contracts like khula.

 Hadees :

“إِنَّمَا الْأَعْمَالُ بِالنِّيَّاتِ”

"Actions depend on intentions." 

(Sahih Bukhari: 1) 

No intention of separation means no khula.

 

Scholars 

(Hanafi, Maliki, etc.) agree: Threats from family or emotional fear = ikrah, so khula doesn't happen (Radd al-Mukhtar).

Your nikah is still valid. Contact local Darul Ifta or a trusted Alim right away for confirmation.
