Is a Khula Signed Under Pressure Valid in Islam?
Question
About forced khula / divorce If a husband and wife signed khula/divorce papers under coercion, where: – the wife was threatened with being thrown out of her parents’ house if she did not sign, – the husband was under extreme family pressure, emotional breakdown, and fear, – neither of them intended separation in their heart, then is this khula Islamically valid according to Qur’an and authentic Sunnah?

VerifiedNo, this khula is not valid in Shariah. Khula is a contract based on free consent. Force or severe pressure (ikrah) makes it invalid, even if papers are signed.
Reference :
“وَلَا تُكْرَهُوا أَنْ يَتَزَوَّجَكُنَّ”
"Do not force them into marriage." (Surah An-Nisa: 19)
Force cancels contracts like khula.
Hadees :
“إِنَّمَا الْأَعْمَالُ بِالنِّيَّاتِ”
"Actions depend on intentions."
(Sahih Bukhari: 1)
No intention of separation means no khula.
Scholars
(Hanafi, Maliki, etc.) agree: Threats from family or emotional fear = ikrah, so khula doesn't happen (Radd al-Mukhtar).
