Validity of Zoom nikah without wali’s consent

Question

Subject: Request for Clarification on Islamic Validity of Marriage Conducted via Zoom Assalamualaikum warahmatullahi wabarakatuh, I am writing to respectfully seek clarification regarding the Islamic validity of a marriage solemnised online where the wali (father) was not informed. It is important to note that both the groom and bride are generally following the Shafiee Mazhab, however, in this circumstance, they are both following the Hanafi Mazhab. The circumstances of the marriage are as follows: * The groom was physically present in Singapore at the time of the akad nikah. * The bride was physically present in the United Kingdom. * The marriage ceremony was conducted online via Zoom/video conference. * The bride’s biological/legal wali was physically present in Singapore, but did not personally conduct the akad. * An officiator acted as wali and solemnized the nikah during the ceremony. * There were two witnesses present on Zoom during the akad: one witness from the groom’s side and one witness from the officiator’s side. * The ijab and qabul were conducted through the online platform in the presence of all parties. In light of these circumstances, I respectfully seek clarification on whether this marriage is Islamically valid according to Syariah principles. Walekumussalam warahmatullahi wabaraktuh,

According to the Hanafi school, this online marriage is invalid because the groom (in Singapore) and the bride (in the UK) were in separate locations over Zoom, so ittihad al-majlis (unity of the session), which is necessary, was not fulfilled. Zoom is not considered a single physical session. The bride’s father was not informed, and the officiator acted as the wali, which is insufficient. Although Imam Abu Hanifa permits an adult woman to marry without a wali, in this case the marriage is still invalid due to the absence of a valid unified session. There were only two witnesses (one from the groom’s side and one from the officiator’s side), whereas the requirement is either two upright Muslim men or one man and two women. Changing from the Shafi‘i school to the Hanafi school does not alter the ruling.

Appoint a representative (wakeel) and conduct the nikah again in one valid session.
