Is It Haram to Default on Credit Card Debt Due to Genuine Financial Hardship?

ุงู„ุณูŽู‘ู„ุงูŽู…ู ุนูŽู„ูŽูŠู’ูƒูู…ู’ ูˆูŽุฑูŽุญู’ู…ูŽุฉู ุงู„ู„ู‡ู ูˆูŽุจูŽุฑูŽูƒูŽุงุชูู‡ู My name is Ali. I have been living in the United Kingdom for around four years. I currently have around ยฃ12,000 in credit card debt. Around the same amount of money was taken from me after I was scammed by someone I considered a friend. Because of that loss, I had to rely on my credit cards to manage my expenses. Now I am unemployed and in serious financial difficulty, and I am unable to make the repayments. Many people close to me have advised me to stop making p ayments and allow myself to become a defaulter because I have no job and cannot afford to pay. I want to make one thing clear: when I borrowed the money from the credit card companies, I never intended to avoid repaying it. My intention was completely sincere, and I fully intended to pay everything back. However, my situation has become extremely difficult, and I have not been able to recover the money from the person who scammed me. I would like to ask: **If I allow myself to become a defaulter because I genuinely cannot afford to repay my debts at this time, would that be considered haram? *ุฌูŽุฒูŽุงูƒูŽ ูฑู„ู„ูŽู‘ูฐู‡ู ุฎูŽูŠู’ุฑู‹*

First: The use of a credit card

If this is a conventional credit card that charges interest (riba) when the outstanding balance is not paid within the specified period, then according to the Hanafi school of jurisprudence, such an agreement is not considered permissible because it contains a condition involving riba. Therefore, a Muslim should avoid using such credit cards as much as possible. If someone is already using one, they should make every effort to exit this arrangement as soon as they reasonably can, pay the outstanding balance promptly to avoid further interest, and sincerely repent to Allah and seek His forgiveness.

Second: Is it haram to become a defaulter due to genuine financial hardship?

If the facts are exactly as you have describedโ€”that when you used the credit card, you genuinely intended to repay the debt, had no intention of deceiving the lender or avoiding repayment, but later became unable to pay because of being scammed, losing your job, and falling into severe financial hardshipโ€”then merely being unable to make the repayments due to this genuine inability is not, in itself, sinful.

However, the original debt remains your responsibility, and whenever Allah grants you the financial ability, you are obligated to repay it.

On the other hand, if a person has the ability to repay but deliberately refuses to do so, or intentionally becomes a defaulter simply to escape paying the debt, then this is unlawful and a grave sin. The Messenger of Allah ๏ทบ said:

ยซู…ูŽุทู’ู„ู ุงู„ู’ุบูŽู†ููŠู‘ู ุธูู„ู’ู…ูŒยป

(Sahih al-Bukhari, Sahih Muslim)

He ๏ทบ also said:

ยซู…ูŽู†ู’ ุฃูŽุฎูŽุฐูŽ ุฃูŽู…ู’ูˆูŽุงู„ูŽ ุงู„ู†ู‘ูŽุงุณู ูŠูุฑููŠุฏู ุฃูŽุฏูŽุงุกูŽู‡ูŽุง ุฃูŽุฏู‘ูŽู‰ ุงู„ู„ู‘ูŽู‡ู ุนูŽู†ู’ู‡ูุŒ ูˆูŽู…ูŽู†ู’ ุฃูŽุฎูŽุฐูŽู‡ูŽุง ูŠูุฑููŠุฏู ุฅูุชู’ู„ูŽุงููŽู‡ูŽุง ุฃูŽุชู’ู„ูŽููŽู‡ู ุงู„ู„ู‘ูŽู‡ูยป

Therefore, if you are genuinely unable to repay at present because of circumstances beyond your control, you will not be sinful merely for this inability. Nevertheless, the debt remains payable whenever you are able.

You should also make every reasonable effort to contact the credit card company, explain your financial circumstances, and seek lawful solutions such as a repayment plan, additional time, or, where available, a reduction or waiver of interest. Doing so demonstrates your genuine intention and sincere effort to fulfil your financial obligation.
