Can riba be taken to donate?

Question

Asalamu Alaikum Sheikh, We know that Interest (Riba) is forbidden, but if someone gains interest (Riba) from a savings account on purpose but intends to give it all away to charity to help people out without expecting reward of course, is it permissible to intentionally receive interest just to give it to charity?

Islamic Ruling & Answer

Verified

Walekumussalam,

The intention of saying, "I will not use the interest (riba) for myself; instead, I will give all of it to the poor," may appear noble. However, a good intention does not make a prohibited act permissible. Therefore, it is not permissible to intentionally open an interest-bearing savings account or deposit money in it with the purpose of earning interest, even if one intends from the outset to donate every penny of that interest without expecting any reward.

The reason is that Islam has not only prohibited consuming riba but has also prohibited engaging in riba-based transactions.

Allah, the Exalted, says:

ÂĢī´ŋŲˆŲŽØŖŲŽØŲŽŲ„Ų‘ŲŽ اŲ„Ų„Ų‘ŲŽŲ‡Ų اŲ„Ų’بŲŽŲŠŲ’ØšŲŽ ŲˆŲŽØŲŽØąŲ‘ŲŽŲ…ŲŽ اŲ„ØąŲ‘ŲØ¨ŲŽØ§ī´ž

“Allah has permitted trade and forbidden riba (interest).”

(Surah al-Baqarah 2:275)Âģ

He also says:

ÂĢī´ŋŲŠŲŽØ§ ØŖŲŽŲŠŲ‘ŲŲ‡ŲŽØ§ اŲ„Ų‘ŲŽØ°ŲŲŠŲ†ŲŽ ØĸŲ…ŲŽŲ†ŲŲˆØ§ اØĒŲ‘ŲŽŲ‚ŲŲˆØ§ اŲ„Ų„Ų‘ŲŽŲ‡ŲŽ ŲˆŲŽØ°ŲŽØąŲŲˆØ§ Ų…ŲŽØ§ بŲŽŲ‚ŲŲŠŲŽ Ų…ŲŲ†ŲŽ اŲ„ØąŲ‘ŲØ¨ŲŽØ§ī´ž

“O you who believe! Fear Allah and give up whatever remains of riba.”

(Surah al-Baqarah 2:278)Âģ

The Messenger of Allah īˇē said:

ÂĢ"Ų„ŲŽØšŲŽŲ†ŲŽ ØąŲŽØŗŲŲˆŲ„Ų اŲ„Ų„Ų‘ŲŽŲ‡Ų īˇē ØĸŲƒŲŲ„ŲŽ اŲ„ØąŲ‘ŲØ¨ŲŽØ§ØŒ ŲˆŲŽŲ…ŲŲˆŲƒŲŲ„ŲŽŲ‡ŲØŒ ŲˆŲŽŲƒŲŽØ§ØĒŲØ¨ŲŽŲ‡ŲØŒ ŲˆŲŽØ´ŲŽØ§Ų‡ŲØ¯ŲŽŲŠŲ’Ų‡ŲØŒ ŲˆŲŽŲ‚ŲŽØ§Ų„ŲŽ: Ų‡ŲŲ…Ų’ ØŗŲŽŲˆŲŽØ§ØĄŲŒ."Âģ

ÂĢ"The Messenger of Allah īˇē cursed the one who consumes riba, the one who pays it, the one who records it, and its two witnesses, and he said: 'They are all equal (in sin).'"Âģ

(Sahih Muslim, Hadith: 1598)

Therefore, deliberately earning interest falls under the warning mentioned in this hadith, even if the person does not keep any of it for personal use afterward.

However, if interest is credited to a person's account without their intention or choice, they must not use it for their own benefit. Instead, they should dispose of it by giving it to the poor or spending it on public welfare without intending to earn any reward, as this is not considered charity but rather a means of ridding oneself of unlawful wealth.
