Skipping hajj due to sectarian differences

Question

Aslam alikum Is it permissible to skip Hajj if a person doesn't want to pray behind imam of a particular sect and don't want to give benefit to a particular government by staying over there.

Walekumussalam,

If Hajj has become obligatory upon a person and all its conditions (such as financial and physical ability) are fulfilled, then merely refusing to perform Hajj because one does not wish to pray behind an imam of a particular sect, or because one does not want to provide any benefit to a particular government by staying there, is not a valid excuse in Islamic law.

Allah Almighty clearly says:

﴿وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلًا ۚ وَمَنْ كَفَرَ فَإِنَّ اللَّهَ غَنِيٌّ عَنِ الْعَالَمِينَ﴾

«"And [due] to Allah from the people is a pilgrimage to the House—for whoever is able to find a way to it. But whoever disbelieves, then indeed Allah is free from need of the worlds."

(Surah Aal 'Imran 3:97)»

Likewise, the Messenger of Allah ﷺ said:

«بُنِيَ الإِسْلَامُ عَلَى خَمْسٍ... وَحَجِّ الْبَيْتِ»

«"Islam has been built upon five pillars... including the pilgrimage to the House (Hajj)."

(Sahih al-Bukhari: 8; Sahih Muslim: 16)»

Therefore, political disagreement with a government or dislike for a particular group or sect does not constitute a legitimate reason to abandon this great obligation that Allah has prescribed. A Muslim's obedience is owed to Allah and His Messenger ﷺ, not to governments or individuals.

As for praying behind the imam, congregational prayer in al-Masjid al-Haram and al-Masjid an-Nabawi carries immense virtue. The scholars have explained that as long as an imam has not committed clear disbelief that takes him out of Islam, the prayer behind him is valid. Merely having juristic or sectarian differences is not a valid justification for abandoning the obligatory Hajj.

Accordingly, if Hajj has become obligatory upon a person, they should fulfill Allah's command and perform Hajj, without allowing such doubts or political sentiments to take precedence over an obligation ordained by Allah.
