Advance Payment & Zakat Concern for friend
Question
Assalamualaikum One of my known person (adil- name changed for privacy) was arrested by police in a case and he went to jail for that and to get him released within a week we were demanded 3 lakh rupees out of which 1 lakh was asked in advance. He was in jail since 13-14 days when this settlement was happening and this settlement was asked through my connections. I paid that 1 lakh from my pocket instantly after his familyโs consent and his brother agreed to that payment but at the time of payment he reverted from his statement saying that he wonโt give any money. He sold adilโs wife jewellery and paid me 1 lakh back. Anyways due to some legal issues we werenโt able to proceed with this step even after giving that advance. Now after a month later adil got bail judicially and that settlement advance of 1 lakh was gone which cant be recovered back from department where it was paid. After bail, adil who is already in debt, and financially weak, came to know that all these things happened behind his back. He is in deep depression and is also mentally disturbed after staying 45 days in jail. And after all this he came to me and demanded that 1 lakh rupees back saying that i am responsible for that amount because it was all my connections where the advance was paid. He has 2 small kids, and he was already in debts, and his jail term of 45 days made him lost his small business too which he was doing. All his parties/clients have set some other persons for the products he was selling to them. Now my question is that the amount of 1 lakh he is asking from me, can i pay that from my zakat or not.? Because the situation is out of control right now and he is talking to me like i ate that amount. Although it was given to the concerned person through his brotherโs hands. Please guide me through this tough situation. Jazakallah.
Islamic Ruling & Answer
VerifiedWalekumussalam,
You gave 100,000 rupees in advance for Adilโs release, which his wife later returned to you by selling her jewelry. The original amount that went to the government/official department is not your legal or Islamic responsibility to return.
If you want to avoid conflict, you can give some money to him as charity or from your zakat, with the intention of reconciliation and kindness, because Adil is financially struggling and he is a rightful recipient of zakat, so giving him zakat is correct in Islamic law.
