Is a Child Conceived Before Nikah Legitimate if the Parents Marry Later?

Question

If I get pregnant before nikkah but we decide to do nikkah as soon as we find out about the pregnancy, will the child be halal and legitimate? Or is aborting it is suggested?

Verified

First of all, it should be clearly understood that having sexual relations before Nikah is strictly prohibited in Islam and is considered a major sin known as zina (fornication/adultery). Allah تعالى has prohibited not only zina itself but even approaching anything that leads to it:

 ﴿وَلَا تَقْرَبُوا الزِّنَى ۖ إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا﴾

“اور زنا کے قریب بھی نہ جاؤ، بے شک وہ بے حیائی کا کام اور بہت برا راستہ ہے۔”

(سورۃ الإسراء: 32)

Likewise, the Messenger of Allah ﷺ said:

  لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ»

“زنا کرنے والا جب زنا کرتا ہے تو اس وقت وہ کامل ایمان کی حالت میں نہیں ہوتا۔”

(صحیح البخاری، صحیح مسلم)

Therefore, if someone falls into this sin, they must sincerely repent to Allah, feel genuine remorse for what they have done, firmly resolve never to return to it, and if they intend to marry each other, they should perform a valid Nikah without unnecessary delay.

As for your actual question: if pregnancy occurs before Nikah and, upon discovering the pregnancy, the couple immediately performs a valid Nikah, this does not make abortion permissible or recommended. Merely becoming pregnant as a result of zina is not a valid Shar‘i reason for abortion.

Regarding the child's lineage according to the Hanafi school, if the child is born at least six lunar months after the Nikah, the child will be attributed to the husband. However, if the child is born before six lunar months from the Nikah, the child's lineage will not be established to the husband. However, in such a case, if the man acknowledges that the child is his without explicitly stating that the child is from zina, then the child's lineage will also be established to him according to the legal ruling mentioned by the jurists.

It should also be remembered that the child bears no sin whatsoever for the actions of the parents. Islam does not permit treating such a child with contempt or depriving them of any of their legitimate rights.

"لو نكحها الزاني حل له وطؤها اتفاقاً، والولد له ولزمه النفقة.

(قوله: والولد له) أي إن جاءت بعد النكاح لستة أشهر، مختارات النوازل، فلو لأقل من ستة أشهر من وقت النكاح لا يثبت النسب، ولا يرث منه إلا أن يقول: هذا الولد مني، ولا يقول: من الزنى، خانية. والظاهر أن هذا من حيث القضاء، أما من حيث الديانة فلا يجوز له أن يدعيه؛ لأن الشرع قطع نسبه منه، فلا يحل له استلحاقه به، ولذا لو صرح بأنه من الزنى لا يثبت قضاءً أيضاً، وإنما يثبت لو لم يصرح؛ لاحتمال كونه بعقد سابق أو بشبهة حملاً لحال المسلم على الصلاح، وكذا ثبوته مطلقاً إذا جاءت به لستة أشهر من النكاح؛ لاحتمال علوقه بعد العقد، وأن ما قبل العقد كان انتفاخاً لا حملاً، ويحتاط في إثبات النسب ما أمكن."
