Question

**Assalamu Alaikum wa Rahmatullahi wa Barakatuh, Mufti Sahab.** Mera ek sawal hai. Main India se bahar ek mulk mein kaam karta hoon, jahan mukhtalif mazhab aur cultures ke log saath kaam karte hain. Un mein se kuch log drink karte hain aur kuch aisi ghizayein bhi khate hain jo Islam mein haram hain, jaise pork waghairah. Office mein kabhi kabhi sab ko saath mein lunch karna padta hai. Wahan ke utensils, jaise glasses, spoons, bowls aur plates, sab log mushtaraka (shared) taur par istemal karte hain. Yani wohi utensils non-Muslim colleagues bhi istemal karte hain aur hum bhi. Mera sawal yeh hai: 1. Kya aise shared utensils ka istemal karna jaiz hai, jab unhein aise log bhi istemal karte hon jo sharab peete hain ya haram ghiza khate hain? 2. Agar utensils zahiri taur par saaf hon, to kya unmein khana ya pani peena durust hai? 3. Agar kabhi office ke taqazon ki wajah se unke saath ek hi table par lunch karna pade, ya kisi wajah se ek hi plate mein se khana pad jaye, to kya yeh Shari'at ke mutabiq jaiz hai? Baraye meherbani Qur'an-o-Sunnat ki roshni mein is masle ki wazahat farma dein. Jazakumullahu Khairan.

Islamic Ruling & Answer

Verified

Walekumussalam warahmatullahi wabaraktuh,

1. Mushtaraka bartan istemal karna jaiz hai, basharte ke woh paak hon

Shari'at ka usool yeh hai ke asal ashya mein taharat hai. Lihaza agar koi bartan zahiri taur par saaf hai aur us par najasat ka koi asar (rang, boo ya zaiqah) maujood nah ho, to us ka istemal jaiz hai, khwah use pehle kisi ghair Muslim ne istemal kiya ho ya us mein koi haram cheez khai gayi ho.

Allah Ta'ala ka irshad hai:

﴿وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ وَطَعَامُكُمْ حِلٌّ لَهُمْ﴾

“Ahl-e-Kitab ka khana tumhare liye halal hai, aur tumhara khana un ke liye halal hai.”

(Surah Al-Ma'idah: 5)

Is ayat se maloom hota hai ke Ahl-e-Kitab ke saath khane peene ke mu'amalat aslan jaiz hain, illa yeh ke kisi haram ya najasat ka yaqeen ho.

2. Sunnat-e-Nabawi ﷺ ki rehnumai

Hazrat Abu Tha'labah Khushani (RA) ne arz ki:

"Hum Ahl-e-Kitab ke ilaqe mein rehte hain, woh apne bartanon mein khinzeer khate aur sharab peete hain, kya hum un ke bartan istemal kar sakte hain?"

Rasulullah ﷺ ne farmaya:

“Agar tumhein un ke ilawa bartan mil jayein to unhi mein khao, aur agar na milen to un ke bartan dho lo, phir un mein khao.”

(Sahih al-Bukhari: 5478, Sahih Muslim: 1930)

Is hadith se fuqaha-e-kiram ne yeh usool akhz kiya hai ke agar yaqeen ho ke bartan najasat se aaloodah hai to use dho kar istemal kiya jaye, aur agar najasat maujood na ho to us ke istemal mein koi harj nahin.

3. Agar bartan zahiri taur par saaf hon

Aaj kal offices, companies aur hotels mein bartan aam tor par achhi tarah dhoye jate hain. Agar bartan zahiri taur par saaf hon aur najasat ka koi asar baqi na ho to un mein khana peena jaiz hai, kyun ke Shari'at mahz shak ya ihtimal ki bunyaad par kisi cheez ko napaak qarar nahin deti.

Fiqhi qa'idah :

«"اليقين لا يزول بالشك"»

“Yaqeen shak se zail nahin hota.”

(Al-Ashbah wan-Naza'ir li Ibn Nujaym)

4. Ghair Muslim ke saath ek hi bartan mein khana

Agar bartan mein koi najasat na ho, ghair Muslim ke haath ya munh par bhi koi najasat na lagi ho, aur khane mein kisi haram cheez ki ameezish na ho, to kabhi kabhar ek hi bartan ya plate mein khane peene mein shar'an koi harj nahin.

Basharte ke bartan paak ho aur us mein koi najasat ya haram cheez maujood na ho.

Albatta ghair Muslimon ke saath mustaqil tor par is andaz ko mamool aur aadat bana lena makruh hai, jaisa ke Fatawa Bazzaziyyah mein hai:

«"والأكل مع الكفار لو ابتلى به المسلم لا بأس لو مرة أو مرتين، أما الدوام عليه يكره."»

Tarjamah: “Agar kisi Musalman ko kabhi majboori ya ittifaqan kuffar ke saath khana khane ki nobat aa jaye to ek do martabah is mein koi harj nahin, lekin ise mustaqil mamool bana lena makruh hai.”

(Al-Fatawa al-Bazzaziyyah, Kitab al-Karahiyyah, al-Fasl al-Thalith fima yata'allaqu bil-Manahi, 6/359, Maktba' Rashidiyyah)

Lihaza agar office ke mahol mein kabhi ittifaqan ya zarurat ke tahat aisa ho jaye to is mein gunjaish hai, lekin bila zarurat ise mamool banana munasib nahin.

5. Ek hi table (Table) par baith kar khana

Agar aap sirf ek hi table par baith kar khana kha rahe hain jabke aap ka khana alag hai, to yeh jaiz hai.

Albatta agar usi majlis mein sharab noshi ho rahi ho aur sharab pesh ki ja rahi ho to aisi majlis mein bila zarurat baithne se ijtinab karna chahiye.

Rasulullah ﷺ ne farmaya:

"جو شخص اللہ اور یومِ آخرت پر ایمان رکھتا ہو، وہ ایسے دسترخوان پر نہ بیٹھے جس پر شراب گردش کر رہی ہو۔"

(Sunan al-Tirmidhi: 2801, Musnad Ahmad, Sunan al-Nasa'i, bi shawahidihi)

Lihaza agar sirf saath baith kar khana hai aur sharab ki majlis nahin to jaiz hai, lekin agar sharab noshi ho rahi ho to hatta al-imkan wahan baithne se bachna chahiye.
