Is a Forced Khula Valid in Islam?

Question

About forced khula / divorce If a husband and wife signed khula/divorce papers under coercion, where: โ€“ the wife was threatened with being thrown out of her parentsโ€™ house if she did not sign, โ€“ the husband was under extreme family pressure, emotional breakdown, and fear, โ€“ neither of them intended separation in their heart, then is this khula Islamically valid according to Qurโ€™an and authentic Sunnah?

Islamic Ruling & Answer

Verified

No, this khula is not valid in Shariah. Khula is a contract based on free consent. Force or severe pressure (ikrah) makes it invalid, even if papers are signed.

Reference :

โ€œูˆูŽู„ูŽุง ุชููƒู’ุฑูŽู‡ููˆุง ุฃูŽู†ู’ ูŠูŽุชูŽุฒูŽูˆู‘ูŽุฌูŽูƒูู†ู‘ูŽโ€

"Do not force them into marriage." (Surah An-Nisa: 19) 

 Force cancels contracts like khula.

 Hadees :

โ€œุฅูู†ู‘ูŽู…ูŽุง ุงู„ู’ุฃูŽุนู’ู…ูŽุงู„ู ุจูุงู„ู†ู‘ููŠู‘ูŽุงุชูโ€

"Actions depend on intentions." 

(Sahih Bukhari: 1) 

No intention of separation means no khula.

 

Scholars 

(Hanafi, Maliki, etc.) agree: Threats from family or emotional fear = ikrah, so khula doesn't happen (Radd al-Mukhtar).

Your nikah is still valid. Contact local Darul Ifta or a trusted Alim right away for confirmation.
