Question
I was 4 months pregnant when I got separated from my husband at that he divorced me verbally than later on I gave birth to a baby girl she is 3 years old almost we never met again in this time period he divorced me multiple times in different occasions more than 20 times and we never met in 4 years after that day he gave verbal divorced to me , but he is not giving in documented form , I want to have a verbal nikkah with someone else now, will it be valid according to shariah?
Islamic Ruling & Answer
VerifiedNo, the marriage does not remain valid merely because the husband is not providing a written divorce—what matters in Shariah is the verbal divorce.
If your husband clearly pronounced divorce even once while you were pregnant, then the divorce took effect at that time, and your waiting period (ʿiddah) lasted until the birth of the child. With the birth of the baby, the ʿiddah was completed and the marriage ended.
After that, any repeated divorces he gave (even 20 times) have no legal effect in Shariah, because the marriage had already ended.
Therefore, if this is indeed the case, you are now Islamically free and may marry another person. A verbal nikah is also valid, provided there is offer and acceptance (ijāb and qabūl), two witnesses are present, and the mahr is agreed upon.
However, as a precaution, it is better to have your full situation reviewed by a qualified scholar or a Darul Ifta to avoid any doubt in the future.
