Question
Assalamualikum Mufti saab, I hope you are well, may Allah bless you and your family. I have a question on behalf of someone. A person I know has divorced his wife three times. He was going through a severe mental health crisis. He wasnโt sleeping, his thoughts were disorganised, and he was saying things that didnโt make sense. A psychiatrist eventually started him on medication to help stabilise his mood and thinking. He has since been diagnosed with bipolar disorder and paranoia. Given all of this, Iโm trying to understand whether the divorces would still be considered valid under these circumstances. Jazakallah Khair
Islamic Ruling & Answer
VerifiedWalekumussalam,
JazakAllah Khair for asking the question.
If a person is suffering from a serious mental illness, like bipolar disorder or paranoia, and at that time their thoughts are confused or they are not fully aware, then the divorces given in that condition may not be valid. In Islam, for a divorce to be valid, the person must be sane and aware.
However, since this is a sensitive and complex matter, The mental condition will be assessed based on observations and medical reports to determine whether, at the time of giving the divorce, the person was in control of their actions or not. So it is important to consult a local qualified scholar or Darul Ifta and show the medical reports so that the correct ruling can be given.
