Weight & Divorce Query

Question

As-salamu alaykum wa rahmatullahi wa barakatuh, Before I knew the divorce rules, which my husband and I were unaware of, I jokingly asked him one day, "At what weight will you leave me or divorce me?" I don't remember the exact word I used, and he replied, "65 kg." He said he would never have left me if I weighed more than 65 kg. In his response, he didn't explicitly state the divorce; he simply stated the weight and added, "Unless you have a valid excuse, like pregnancy or illness." He meant that he didn't want me to exceed that weight. Is this considered a conditional divorce? BarakAllahu fik. Thank you in advance for your response.

Islamic Ruling & Answer

Wa Alaikum Assalam,

No, this is not a conditional divorce.

He did not use clear divorce words.

It was a joke, not a serious intention.

In Islam, a conditional divorce requires clear divorce words tied to a condition.

Your marriage is safe. For full reassurance, you should contact your local Darul Ifta for an official opinion.
